JUSTICE SHIVAJI PANDEY ORAL ORDER 10-04-2019 Heard learned counsel for the petitioners and learned counsel for the State as also counsel for the Informant. Earlier vide order dated 6.2.2019, this Court has granted anticipatory bail to the petitioner no.2, Lalu @ Lalu Kumar Yadav @ Lalan Yadav and, hence, the present order is confined to petitioner no.1 only.
In this case, the petitioner is apprehending her arrest in connection with Salakhua P.S. Case No. 174 of 2018 registered for offences under sections 498(A), 364, 365/34 of the Indian Penal Code and subsequently added Section 304(B), 302, 201 of the Indian Penal Code.
The petitioner no.1 is the mother of the husband of
Patna High Court CR. MISC. No.6786 of 2019(5) dt.10-04-2019 2/3 the victim Baby Devi. Allegation has been made that the marriage of the daughter of the Informant with the Amar Yadav four years ago under the Hindu rites and ritual. After two years on Duragman, his daughter reached at he matrimonial home where the accused persons started torturing her due to which she gone to the house of her cousin mother-in-law and from there, she is traceless along with her husband.
Learned counsel for the petitioner submits that in fact the first husband of the victim lady has died and, thereafter, she entered into the second marriage with Ramdeo Yadav who is in custody.
In the entire case diary, no specific allegation has been made against the petitioner no.1.
Looking to the entire facts and circumstances of the case, let the petitioner no.1, above named, in the event of her arrest or surrender before the court below within a period of four weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate IV, Saharsa in connection with Salakhua P.S. Case No. 174 of 2018, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. as also subject to condition that
