The petitioner seeks bail in Bhagwanpur P.S. Case No. 233 of 2018, registered for the offence punishable under Sections 302/34 of the Indian Penal Code.

As per the FIR, this petitioner along with co-accused persons killed the son of informant.

It is submitted on behalf of the petitioner that informant is not eye-witness of the occurrence. Only on suspicion petitioner has been made accused in this case. There is general and omnibus allegation. Petitioner is in custody since 15.11.2018 having no criminal antecedent.

Learned APP however, vehemently opposed the prayer for bail and submitted that there is specific and direct

Patna High Court CR. MISC. No.8374 of 2022(3) dt.16-05-2022 2/2 allegation against this petitioner of committing murder of informant's son.

Considering the facts aforesaid and the nature of allegation, I am not inclined to enlarge the petitioner abovenamed on bail. Accordingly, the same is rejected. (Prabhat Kumar Singh, J) vinita/- U T
