Mr. APP ====================================================== CORAM: HONOURABLE MR. JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 20-06-2022 Heard learned counsel for the petitioner and learned APP for the State.

The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 376, 323, 504 and 506/34 of the Indian Penal Code and Sections 4/6 of the POCSO Act.

It is a case of committing rape of the victim/informant by the petitioner.

It is submitted by learned counsel for the petitioner that the petitioner has falsely been implicated in this case. He further submits that the averment made by the victim is not supported and corroborated by the other witnesses of the case. and the medical report finds no sign of rape. Learned APP appearing for the State has opposed the

Patna High Court CR. MISC. No.18108 of 2021(4) dt.20-06-2022 2/2 prayer for anticipatory bail and submits that from perusal of the case diary, it appears that the other witnesses have also supported the prosecution case in respect of committing the rape.

After considering the aforesaid facts, I am not inclined to grant anticipatory bail to the petitioner. Prayer for anticipatory bail of the petitioner is rejected.
