The petitioner seeks bail in a case registered for the offence punishable under Sections 341, 323, 379, 504, 506/34 of the Indian Penal Code and Section 27 of the Arms Act. Vide order dated 19.01.2022, prayer for anticipatory bail of the petitioner was dismissed as withdrawn as the counsel for the petitioner has no contract/instruction from the client. Learned counsel for the petitioner submits that after filing of the anticipatory bail, the petitioner and his son, who is pairvikar, had gone to Mumbai for their livelihood where he lost his mobile due to which he was not able to contact the counsel. He submits that due to non-instruction, the counsel for the petitioner had prayed for withdrawal of the case. He further submits that petitioner has no criminal antecedent as stated in para-3 of the bail application.

Considering the facts and circumstances of the case, the above named petitioner in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Parwalpur P.S. Case No. 343 of 2020, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
