Versus
1. The State of Bihar through Principal Secretary, Urban Development Housing Board, Bihar, Patna.
2. The Commissioner, Darbhanga Division, Darbhanga.
3. The District Magistrate, Darbhanga.
4. The Municipal Commissioner, Municipal Corporation, Darbhanga. .... .... Respondent/s =========================================================== Appearance :
For the Petitioner/s : Mr. Girish Chandra Jha For the Respondent/s : Mr. ABBAS HAIDER - SC-6 =========================================================== CORAM: HONOURABLE MR. JUSTICE ASHWANI KUMAR SINGH ORAL JUDGMENT Date: 20-11-2017 In the present writ petition the petitioner seeks a direction to the respondents to allot shop no.33 situated at B.K.Road, Laheriasarai, Darbhanga belonging to the Municipal Corporation, Darbhanga on the ground that the said shop was sub-let by one Ramakant Choudhary to the petitioner and her husband and she is running a hair cutting saloon in the said shop. 2.
Admittedly, the petitioner is not a bonafide allottee of the said shop. The petitioner has also failed to produce any agreement in order to show that she or her husband was ever allotted the shop in question by the respondent Municipal Corporation. 3.
I am of the opinion that in such matters no mandamus
Patna High Court CWJC No.16777 of 2017 dt.20-11-2017 2/2 can be issued to the respondents to allot the shop to the petitioner. 4.
The writ petition is misconceived. It is dismissed accordingly.
