The petitioner seeks bail in connection with Janta Bazar P.S. Case No. 162 of 2017 instituted for the offences under Sections 272, 273 and 308 and Sections 30(a) and 41 of the Bihar Prohibition & Excise Act, 2016.

Learned counsel for the petitioner submits that the petitioner is in custody since 22.12.2021, charge-sheet has been submitted in the case and has antecedent of four cases and allegation is of recovery of 2600 liters of liquor from a drum. Learned counsel for the petitioner submits that the petitioner was not arrested from the spot and his name came on secret information received by the police.

Learned A.P.P. for the State vehemently opposes the

Patna High Court CR. MISC. No.7938 of 2022(2) dt.09-03-2022 2/2 prayer for bail of the petitioner.

Considering the fact that the petitioner is in custody since 22.12.2021 and charge-sheet has been submitted in the case and was not arrested from the spot, let the petitioner above named be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned 2nd Exclusive Special Excise Court, Saran at Chapra in connection with Janta Bazar P.S. Case No. 162 of 2017.
