2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 191(2), 191(3), 190, 126(2), 115(2), 117(2), 109 and 352 of BNS. Later on, Section 103(1) of BNS was added.

3. The case of the prosecution is that the informant's father was surrounded and brutally assaulted at Mohini Chowk by the named accused persons using iron rod, bricks, bamboo and sticks, resulting in severe head injuries. Thereafter, he died during course of his treatment.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. Learned counsel for the petitioner has submitted that from perusal of the

Patna High Court CR. MISC. No.8658 of 2026(2) dt.17-02-2026 2/2 FIR, it is clear that the main thrust of allegation is against Rama Paswan and Raushan Sahu. No any specific overt act has been attributed against the petitioner. Petitioner is only the member of mob. Learned counsel has also submitted that similarly situated co-accused person has already been granted bail by learned coordinate Bench of this court vide Cr. Misc. No. 7080 of 2026. The case of this petitioner stands on similar footing. Moreover, the petitioner is languishing in judicial custody since 03.09.2025.

5. Learned APP appearing for the State has vehemently opposed the prayer of regular bail.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Bahadurpur P.S. Case No. 410 of 2025 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate IX, Darbhanga.
