2. The petitioner seeks bail in connection with Nagar P.S. case No. 562 of 2023 instituted for the offences under Sections 25(1-B)a, 26, 35 of the Arms Act.

3. It is alleged that one live cartridge was recovered from the possession of this petitioner.

4. Learned counsel for the petitioner submitted that the petitioner has falsely been implicated in the present case due to his antecedents. Charge-sheet has been submitted in this case. Similarly situated co-accused person has already been granted bail by a Coordinate Bench of this Court vide order dated 20.02.2024 passed in Cr. Misc. No. 8661 of 2024. It has been submitted on behalf of the petitioner that the petitioner is in

Patna High Court CR. MISC. No.12266 of 2024(2) dt.28-02-2024 2/2 custody since 30.08.2023 and has five criminal antecedents.

5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner.

6. Considering the aforesaid facts and circumstances of the case, claim based on parity as also the period of custody undergone by the petitioner, this Court is inclined to grant bail to the petitioner.

7. Let the petitioner be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Court below/concerned Court in connection with Nagar P.S. case No. 562 of 2023.
