The petitioner seeks bail in connection with Shikarpur Police Station Case No.386 of 2019 registered under Sections 25(1-b ) a, 26 and 35 of the Arms Act.
Learned counsel appearing on behalf of the petitioner submits that it would appear from the F.I.R. that the petitioner along with others were apprehended by the police from a room, in course of investigation of Sikta P.S. Case No.74 of 2019 instituted in respect of the kidnapping of a person, from where one bag, containing one loaded country made pistol was recovered. Further submission is that the petitioner is in custody since 10.09.2019 and the similarly situated co-accused
Patna High Court CR. MISC. No.9787 of 2020(2) dt.28-02-2020 2/2 Mahboob Alam has already been granted bail by this Court vide order dated 06.12.2019 passed in Criminal Misc. No.80206 of 2019.
Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Bettiah, West Champaran, in connection with Shikarpur Police Station Case No.386 of 2019.
