The petitioner apprehends his arrest in a case registered for the offence punishable u/s 302, 201/34 of the IPC. Allegedly, all the accused including the petitioner are said to have killed the sister of the informant and cremated her dead body secretly. It is further alleged that she was subjected to continuous torture by her in-laws for giving birth to a female child and for demand of motorcycle and cash.

It is submitted by learned counsel for the petitioner that petitioner is quite innocent and has committed no offence. He is husband of the deceased and has never tortured the deceased. There is no specific overt act against him. In para-12 of the bail petition, it is specifically stated that the deceased died due to cold. Petitioner has no criminal antecedent.

Patna High Court CR. MISC. No.7362 of 2023(2) dt.13-04-2023 2/2 Learned APP for the State opposed the prayer for anticipatory bail by submitting that there is allegation against the petitioner and there is only a statement at para-12 that deceased died due to cold but not a single chit of paper has been enclosed in support of this contention.

Having regard to the facts and circumstances of the case and considering the nature of allegation, I am not inclined to enlarge the petitioner on bail. The prayer for grant of anticipatory bail on his behalf is hereby rejected. This application is accordingly dismissed.
