JUSTICE DINESH KUMAR SINGH ORAL ORDER 16-01-2015 Petitioners are languishing in custody since 14.05.2014 and 02.07.2014 in a case registered for the offences punishable under Sections 386, 387, 302/34 of the I.P.C. It is alleged that petitioners and Fulchand Singh @ Santosh Singh came to the house of the informant assaulted her son that why the husband of the informant demanded rupees four lacs as extortion and thereafter they took the son of the informant to orchard and badly assaulted but when villagers came to rescue the accused persons fled away. Subsequently the son of the informant succumbed to the injuries.

It is submitted by learned counsel for the petitioners that accusation has been levelled since the victim eloped with the wife of Fulchand Singh @ Santosh Singh for

Patna High Court Cr.Misc. No.40425 of 2014 (3) dt.16-01-2015 2/2 which protest was made and petitioners are supporters of Fulchand Singh @ Santosh Singh. Moreover the accusation is omnibus and general against the accuse persons. It is submitted by learned counsel for the informant and the State that accusation of assault is specific which is being corroborated by the medical evidence. Considering the nature of accusation, this Court is not inclined to grant bail to the petitioners at present. Accordingly the application is dismissed in connection with Nao Kothi P.S. Case No. 51 of 2014, pending in the Court of learned Judicial Magistrate, 1st Class, Begusarai. (Dinesh Kumar Singh, J) Shageer/- U T
