JUSTICE AMARESH KUMAR LAL ORAL ORDER 13-02-2015 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks bail in a case registered for the offence punishable under Sections 376/504 of IPC. Allegation against the petitioner is that by threatening the victim/informant he has committed rape upon her. It is submitted that the doctor has not found any sign of recent sexual act.

Learned counsel for the State has submitted that the doctor has not ruled out the commission of rape. The witnesses have also supported the prosecution case. After investigation charge-sheet has already been submitted in this case.

Patna High Court Cr.Misc. No.41420 of 2014 (3) dt.13-02-2015 2/2 Considering the facts and circumstances, in my opinion, the petitioner does not deserve bail at this stage. His prayer for bail is rejected.
