1. Heard learned counsel for the parties.

2. The petitioner has preferred this application for grant of regular bail in connection with Harpur P.S. Case no.35 of 2025, registered under sections 303(2), 317(5), 336(3) and 3(5) of the Bharatiya Nyaya Sanhita, 2023.

3. As per the prosecution case, the informant states that his stolen Bolero vehicle was traced at the house of one Gurudev Pandit. On further enquiry it transpired that the said Gurudev Pandit had purchased the same from the petitioner.

4. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the case. From the contents of the F.I.R. itself it would transpire that the alleged recovery of the stolen vehicle of the informant is not from the petitioner but from the co-accused Gurudev Pandit. The

Patna High Court CR. MISC. No.11642 of 2026(2) dt.25-02-2026 2/2 petitioner has no concern either with the said Gurudev Pandit nor had he sold the vehicle to him. Gurudev Pandit has already been enlarged on bail. The petitioner is in custody since 2.12.2025 and undertakes to cooperate in the investigation/trial.

5. The application for bail is opposed by learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the allegations in the F.I.R., the recovery of the informant's vehicle not being from the petitioner but from the co-accused Gurudev Pandit and the petitioner having remained in custody since 2.12.2025, the petitioner is directed to be enlarged on bail in connection with Harpur P.S. Case no.35 of 2025, on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate Ist Class, Munger.
