02. In the present case, the petitioner seeks bail in connection with Riga P.S. Case No. 246 of 2024 registered for the alleged offences under Section 309(6) of Bharatiya Nyaya Sanhita, 2023.

03. As per prosecution case, four miscreants on their motorcycle dashed the motorcycle of the informant and one of them gave a knife blow in the abdomen of the informant, who somehow saved himself. The second blow of knife hit on the right side of neck of the informant, causing injury to him. The miscreants snatched the Pulsar motorcycle, mobile phone, gold chain worth Rs. 1.5 lac and cash of Rs. 22,000/- from the informant. The name of the petitioner transpired during

04. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. No occurrence as alleged has ever taken place. Nothing incriminating has been recovered from the conscious possession of the petitioner and he has not been put to any test identification parade till date. The name of the petitioner transpired in the confessional statement of co-accused Shivam Kumar and apart from that there is no material against the petitioner. The petitioner is in custody since 16.10.2024 and charge-sheet has been submitted. The petitioner is having antecedent of six case but in four of such cases, he has not been remanded and in other two cases, he is on bail.

05. Learned APP for the State opposes the submission made on behalf of the petitioner.

Having regard to the facts and circumstances and submissions made on behalf of the parties and considering the period of custody of the petitioner along with submission of charge-sheet, the petitioner above named is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-VI,

Patna High Court CR. MISC. No.6637 of 2025(4) dt.14-05-2025 3/3 Sitamarhi/court concerned in connection with Riga P.S. Case No. 246 of 2024, subject to the conditions mentioned in Section 480(3) of BNSS and the following conditions:

(i) One of the bailors will be a close relative of the petitioner.

(ii) The petitioner will remain present on each and every date fixed by the court below.

(iii) In case of absence on three consecutive dates or in violation of the terms of the bail, the bail bond of the petitioner will be liable to be cancelled by the court concerned.
