2. The petitioner has preferred this application for grant of regular bail in connection with Laheri P.S. Case No. 362 of 2020 dated 29.08.2020 registered for the offences punishable u/ss 341, 323, 354, 307, 379, 406, 504, 506, 448, 427 read with section 34 of the Indian Penal Code.

3. As per the prosecution case, the petitioner along with his family was living in the rented house of the informant. When the informant asked for rent and electricity bill, the petitioner and his family members threatened to kill, abused and assaulted the informant. It is further alleged that the co-accused Abhisekh Kamat snatched the golden chain and cash of Rs.

Patna High Court CR. MISC. No.6411 of 2025(2) dt.08-04-2025 2/3 1200/- from the informant on the point of pistol.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. No incriminating material has been recovered from the conscious possession of the petitioner. The petitioner was present at his service place Shivhar at the the time of the alleged occurrence. The petitioner has no criminal antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 20.11.2024.

5. Learned counsel for the informant as well as learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner. It is further stated that the anticipatory bail of the petitioner has already been rejected by the Hon'ble Supreme Court dated 16.05.2023 in petition(s) for special leave to Appeal (Crl.) No. 5782 of 2023.

Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Biharsharif, Nalanda in connection with Laheri P.S. Case No. 362 of 2020, with a condition/s:-

Patna High Court CR. MISC. No.6411 of 2025(2) dt.08-04-2025 3/3 (i). The petitioner is directed to remain physically present before the learned Court below on each and every date, failing which on two consecutive dates without reasonable cause, the bail bond of the petitioner is liable to be cancelled.
