Petitioners are named in the first information report but according to the prosecution case itself, co-accused Nakul Yadav and Sarwan Yadav along with 7 to 8 persons went to the house of informant and took her husband.

Learned counsel for the petitioners submits that the informant has admitted in her fardbeyan that it was one Ritesh Choudhary who narrated the entire occurrence to her on telephone and statement of Ritesh Choudhary was recorded at para 7 of the case diary in which the aforesaid Ritesh Choudhary did not name the petitioners. Learned counsel for the petitioners further submits that having more or less similar allegation co-accused have Ghanshyam

Patna High Court Cr.Misc. No.45163 of 2015 (2) dt.30-09-2015 Yadav and Manohar Yadav already been granted privilege of bail by different benches of this court.

Considering the aforesaid facts and circumstances as well as submissions of the parties and also taking note of this fact that petitioners do not have any criminal antecedent, let the petitioners be released on bail on furnishing bail bonds of Rs 10,000/- each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Bhagalpur in Kotwali (Barari) P.S. Case no. 637/2014.
