The instant application has been filed for initiation of a contempt proceeding against the opposite parties for their willful defiance of the order of this Court dated 06.09.2021 passed in C.W.J.C. No.20588 of 2019, whereby the learned Court has disposed off the writ petition with a direction to the District Programme Officer (Establishment), Samastipur to consider and dispose of the representation dated 23.01.20217 filed by the petitioner within a period of twelve weeks.

3. A show-cause affidavit has been filed bringing on record the order passed by the District Programme Officer (Establishment), Samastipur as contained in Memo No.1516 dated 29.03.2022.

4. It has been informed to this Court that since the petitioner had failed to produce the necessary document(s) to support the averment regarding deposit of due advance amount to the tune of Rs.31,481/-, besides some other documents, 'No Dues Certificate' could not be issued leading to non-payment of pensionary benefit(s).

5. Learned Advocate for the petitioner submitted that after passing of the order, afore-noted, the petitioner has submitted all the necessary documents besides the evidences showing that complete charges have also been handed over to the Headmaster of the school. It has also been informed that a sanctioned letter has also been issued in favour of the petitioner for payment of all the pensionary benefits to the tune of Rs.24,60,418/-. Despite the aforesaid fact, till date payment has not been done.

6. Having considered the submissions advanced by the learned Advocate for the respective parties and taking note of subsequent development, this Court deems it fit and proper to

Patna High Court MJC No.199 of 2022(3) dt.31-10-2025 3/3 dispose off the contempt petition with hope and expectation that all the concerned authorities shall take sincere efforts to ensure payment of due pensionary benefit(s) to the petitioner expeditiously.
