2. The petitioner seeks regular bail in connection with Barahat P.S. Case No. 185 of 2023 registered for the offence under Sections302/34 of the Indian Penal Code and U/s 27 of Arms Act.

3. As per the prosecution case, there is an allegation of indiscriminate firing against accused persons for killing the deceased but due to enmity the name of the petitioner has been given.

4. Learned counsel for the petitioner submits that the petitioner is a person of clean antecedent and is in custody

Patna High Court CR. MISC. No.10523 of 2024(2) dt.22-02-2024 2/2 since 22.09.2023. He further submits that the deceased was a veteran criminal and was accused in six criminal cases including two cases of murder and he may have been killed by his enemies but taking advantage of the same the petitioner and other accused persons have been implicated in this case.

5. Learned A.P.P. has vehemently opposed the prayer for bail.

6. Considering the aforesaid facts and circumstances, this application for regular bail is allowed.

7. Let the petitioner, above named, be released on bail after framing of charge, on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-I, Banka in connection with Barahat P.S.
