JUSTICE MOHIT KUMAR SHAH ORAL ORDER 16-09-2022 The present writ petition has been filed for quashing the notice dated 19.10.2019, whereby and whereunder the Circle Officer, Kesariya Anchal, District-East Champaran i.e. the respondent no. 3 has issued a notice to the petitioner to appear before him and show cause as to why appropriate action be not taken against him under the appropriate provisions of law. At the outset, the learned counsel for the petitioner seeks liberty on behalf of the petitioner to approach the respondent no. 3 by filing objection/show cause reply, and in the meantime, seeks some protection.

Patna High Court CWJC No.8196 of 2021(2) dt.16-09-2022 2/2 Having regard to the facts and circumstances of the case, the writ petition stands disposed off as not pressed, however, with liberty to the petitioner to approach the respondent no. 3 and file his objection/show cause reply, within a period of four weeks from today, which shall be considered by the respondent no. 3 and appropriate orders under Section 6(1) of the Bihar Public Land Encroachment Act, 1956, shall be passed, within a period of 12 weeks, thereafter. It is needless to state that for a period of 16 weeks from today, status quo existing as on today, shall be maintained. The writ petition stands disposed off.
