JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 17-04-2023 Heard learned counsel for the petitioner and the State. The petitioner apprehends arrest in a case registered for the offence punishable under sections 406/420/504/506 of the Indian Penal Code.
Learned counsel for the petitioner submits that the petitioner is not named in the FIR. Petitioner's name has figured during course of investigation as one of the witnesses of the alleged bond papers. He submits that Kamlesh Roy who had taken tractor on loan has already been granted bail by the Court below itself. It is also the case of the petitioner that the petitioner has not received any penny in the transaction. Petitioner has got no criminal antecedent.
Considering the aforesaid facts of the case, prayer for bail of the petitioner is allowed. In the event of arrest/surrender
Patna High Court CR. MISC. No.7038 of 2023(2) dt.17-04-2023 2/2 within six weeks from today, let the petitioner mentioned above be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Vaishali at Hajipur in Mahua Police Station Case No. 237 of 2022, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
