The petitioner seeks bail in a case registered under Sections 306/34 of the Indian Penal Code.

The mother of the deceased made allegation that her daughter and three children were burnt to death. The petitioner had a quarrel with his wife and, on account of such, the wife of the petitioner along with three children were burnt to ashes. It is submitted that during the course of investigation, the witnesses have stated that the wife confined herself inside a room along with her children and ignited fire causing death of the four. The petitioner did not commit any offence. On account of some family dispute, the wife took the extreme step. The petitioner is in jail since 01.12.2014.

It appears that it was the petitioner who had a quarrel

Patna High Court Cr.Misc. No.22418 of 2015 (3) dt.04-09-2015 2/2 with his wife and the wife along with her three children were found dead inside the room.

Considering the facts aforesaid and the fact that the petitioner is the husband, I am not inclined to enlarge the petitioner on bail at this stage in Kunauli P.S. Case No. 71 of 2014. Accordingly, the same is rejected.

The trial court is directed to expedite the trial and conclude the same within nine months from the date of receipt/production of a copy of this order.
