JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 08-04-2019 This application under Article 226 of the Constitution of India has been filed by the petitioner for directing the respondents concerned to institute First Information Report (for short 'FIR') under appropriate provisions of the penal code against the culprits, as alleged in the written report contained in Annexure-3 to this petition.
2. At the outset, it has been pointed out by the learned counsel for the State that the writ petition has become infructuous in view of the fact that Bypass P.S. Case No.89 of
Patna High Court CR. WJC No.557 of 2019(2) dt.08-04-2019 2/2 2019 dated 02.04.2019 has already been instituted on the basis of written report submitted by the petitioner and the case is being investigated upon.
3. The submission made by the learned counsel for the State has not controverted by the petitioner.
4. In view of the assertions made by the learned counsel for the State, the writ petition is dismissed as infructuous.
