2. The petitioner has prayed for bail in a case registered for the offence punishable under sections 332, 353, 399, 402, 411, 412, 414, 467, 471 of the Indian Penal Code and sections 25 (1-b)a, 26 and 35 of the Arms Act.
3. As per allegation in the FIR, four accused persons riding on two motorcycles including the petitioner were apprehended on spot with fire-arms, knife and other objectionable materials. On search, from possession of the petitioner, one loaded country made pistol and one cartridge, one mobile and cash of Rs. 25,000/- were recovered. It is submitted by learned counsel for the petitioner that petitioner has been falsely implicated in this case.
Patna High Court CR. MISC. No.7360 of 2023(3) dt.07-08-2023 2/2 Petitioner has not been put on TIP as yet. Petitioner is not the owner of the seized motorcycle. Similarly situated other coaccused person has already been granted bail by this Court vide order dated 15.5.2023 passed in Cr. Misc. No. 12596 of 2023. Petitioner is languishing in judicial custody since 16.08.2022. The application for bail is opposed by learned APP for the State.
Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned JM 1st Class, Patna in connection with Patrakarnagar P.S. Case No. 482 of 2022.
