JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 05-01-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner happens to be husband of the deceased. The present case was lodged on the basis of complaint petition filed by mother of the deceased on 16.04.2014 i.e. near about after one month of death of the deceased. In course of investigation, the informant and her family members stated that cause of death of the deceased was dowry death whereas some witnesses stated that deceased was suffering from epilepsy but they could not disclose the cause of death. The third set of witnesses stated that deceased consumed poison and while she was being taken to hospital, she died on her way. The aforesaid witnesses stated that brother of the deceased
Patna High Court Cr.Misc. No.44338 of 2015 (3) dt.05-01-2016 2/2 was present when deceased died and after that in presence of brother of the deceased, the dead body was cremated. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge-V, Madhubani in connection with Sessions Trial No. 378 of 2014 arising out of Jainagar P.S. Case No. 90 of 2014.
