JUSTICE VINOD KUMAR SINHA ORAL JUDGMENT Date : 08-03-2019 The appellant seeks pre arrest bail in connection with Phulparas P.S. Case No. 329 of 2016, registered for offences punishable under Sections 341, 323, 504 of the Indian Penal Code and Section 3(i)(x), 3(2)(va) of SC/ST (POA) Act. Appellant happens to be a teacher and allegation against the appellant is of abusing the wife of informant by caste name. It has been submitted on behalf of the appellant is that as a matter of fact a dispute arose between the wife of the informant, who is a ward member, and head mistress of the school in which, the appellant also intervened and due to which, he has been roped in the present false case. Further he is Government servant and is ready to abide by any condition imposed on him.

Having heard both sides, considering the facts and

APP (SJ) No.461 of 2019 dt.08-03-2019 2/2 circumstances of the case, let the appellant, above named, in the event of his arrest or surrender before the Court below within a period of six weeks, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned A.D.J.-I-cum-Special Judge, Madhubani, in connection with Phulparas P.S. Case No. 329 of 2016, subject to the conditions laid down under Section 438 (2) of Cr.P.C.

Accordingly, this appeal is allowed and impugned order is set aside.
