The petitioner seeks bail in Dhansoin P.S. Case No.43 of 2019 registered for the offence punishable under Section 392 of the Indian Penal Code.

The allegation against the petitioner is of snatching of Rs.55,000/- cash, while he was going with his motorcycle after withdrawing money from a Bank.

Submission of learned counsel for the petitioner is that the petitioner has been falsely implicated in this case and he is in custody since 03.10.2019. Further submission is that nothing incriminating article has been recovered from the conscious possession of the petitioner nor he has been put on T.I.Parade. The petitioner is not named accused in this case and he has been made accused on the basis of confessional statement

Patna High Court CR. MISC. No.5834 of 2020(2) dt.03-02-2020 2/2 of the co-accused.The petitioner is also accused in similar type of four cases.

Heard learned Addl. Public Prosecutor.

Be that as it may, considering facts and circumstances, as stated above, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.25,000/-(twenty five thousand) with two sureties of the like amount each to the satisfaction of Addl. Chief Judicial Magistrate-III, Buxar in connection with Dhansoin P.S. Case No.43 of 2019 with condition that he has to appear before the local police station of his area for a period of nine months or till the conclusion of the trial, whichever is earlier, so that the police may watch the activities of the petitioner, otherwise the bail bond of the petitioner shall be cancelled.

Let a copy of this order be communicated to the Superintendent of Police, Buxar for the needful. With the above observation, this application is allowed.
