The petitioner apprehends his arrest in a criminal prosecution registered under Sections 302/120B of the Indian Penal Code.
Taking into consideration the fact that the petitioner is the husband of the deceased and he is alleged to have participated in the crime in question, this Court is not inclined to accede to the prayer made on behalf of the petitioner for grant of anticipatory bail in connection with Paru P.S. Case No.49 of 2009 pending in the court of learned Sub-Divisional Judicial Magistrate (West), Muzaffarpur. Accordingly, his prayer for anticipatory bail is rejected.
However, if the petitioner surrenders in the court below within a period of four weeks from today and makes a prayer for regular bail, then the same shall be considered and decided on its own merits, without being prejudiced/influenced by the present order.
