====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 03-03-2025 Heard learned counsel for the petitioner and the State.

2. Petitioner apprehends arrest in a case registered for the offences punishable under Sections 111(2)(B), 111(3), 111(4) of the Bharatiya Nyaya Sanhita and Section 30(a) of Bihar Prohibition and Excise Act.

3. As per prosecution case, total 2583 liters foreign liquor was recovered from different vehicles.

4. Learned counsel for the petitioner submits that no incriminating material has been recovered from conscious possession of the petitioner and he has been made accused in this case only on suspicion. Petitioner is neither driver nor owner of any of the vehicles in question and is not concerned with the alleged recovery.

5. Learned A.P.P. for the State opposes the prayer for

Patna High Court CR. MISC. No.7302 of 2025(2) dt.03-03-2025 2/2 bail and submits that the petitioner has got ten criminal antecedents of similar nature.

6. Considering the huge quantity of recovery and criminal antecedents of similar nature, prayer for anticipatory bail of the petitioner is refused.
