The recovery of stolen bicycle was made from the repairing shop of the petitioner on the basis of confessional statement, made by co-accused Santosh Ram. The petitioner is languishing in jail custody since 12-06-2015 and it is surprising enough that even then, the learned Ist Additional Sessions Judge, Supaul rejected the prayer for bail of the petitioner without applying his judicial mind.

Accordingly, petitioner named above, is directed to be released on bail on furnishing bail bond of Rs 10,000/- (ten thousand) with two sureties of the like amount each in connection with Kishanpur P.S. Case No. 97 of 2015 to the satisfaction of Chief Judicial Magistrate, Supaul.
