JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-03-2020 Appellant seeks bail in connection with Sasaram (Muffasil) P.S.Case No. 139 of 2019 registered for the offences punishable under Sections 302, 34 of the Indian Penal Code and Section 3(2)(v) of Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, including Section 27 of the Arms Act.

As per prosecution case, appellant called cousin brother of the informant and thereafter accused persons, including the appellant surrounded him and one Bhodu Yadav shot him dead.

Submission of learned counsel for the appellant is that the no specific allegation has been attributed against him except he called the deceased and he is in custody since 11.8.2019 and

Patna High Court CR. APP (SJ) No.436 of 2020(4) dt.20-03-2020 2/2 charge sheet has been submitted.

Heard learned Special P.P.

In view of above facts and circumstances, the appeal is allowed and the impugned order dated 28.4.2019 is set. Let appellant, named above, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge-I, Rohtas at Sasaram, in connection with Sasaram (Muffasil) P.S.Case No. 139 of 2019.
