The petitioner is apprehending his arrest in a case registered for the offence punishable under Sections 366A/34 of the Indian Penal Code.
Prosecution case in short is that the accused persons forcibly abducted the daughter of the informant. Learned counsel for the petitioner submits that the petitioner is not named in the FIR and has falsely been implicated in the present case. There is vast contradiction in the statement of the victim under Sections 161 and 164 of the Cr.P.C. The parties have already entered into compromise by the Deepak Kumar Jha (Annexure-3 series). The petitioner has got no criminal antecedent. The similarly situated co-accused has
Patna High Court CR. MISC. No. 9324 of 2020(2) dt.02-03-2020 2/2 been granted anticipatory bail by the Co-ordinate Bench of this Court vide order dated 28.02.2019 in Cr. Misc. No.11938 of 2019.
In the aforesaid facts and circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of six weeks from the date of receipt of the order, be released on anticipatory bail on furnishing bail bonds of Rs. 20,000/- (rupees twenty thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-VI, Gopalganj, in connection with Sidhwalia, P.S. Case No. 248 of 2018, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
