2. The present petition has been preferred for issuance of a writ in the nature of certiorari or any other appropriate writ, order or direction to quash Memo no. 2507 dated 28.12.2023 issued under the signature of District Magistrate, Khagaria.
3. Learned State Counsel submits that the letter of the District Magistrate, Khagaria clearly shows that he has already constituted an enquiry team. He further submits that the necessary parties are missing in the list of respondents.
4. This Court is in full agreement with the learned
Patna High Court CWJC No.2801 of 2024(2) dt.02-07-2024 2/2 State Counsel, the document in question, the memo no. 2507 dated 28.12.2023 issued by the District Magistrate, Khagaria clearly shows that he has constituted a fresh team under the leadership of the Deputy Collector, Land Reforms, Khagaria and instead of waiting for the outcome of the said enquiry report, the petitioner rushed to this Court.
5. At this stage, learned counsel for the petitioner submits that he will await the enquiry report of the District Magistrate, Khagaria before taking further steps and would like to withdraw the petition for the present.
