====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR SINHA ORAL ORDER 23-07-2025 Heard Mr. Niraj Kumar Singh, learned counsel for the petitioner, learned APP and Ms. Akrity Aishwarya, learned counsel for the Opposite Party No.2.

2. This application, for grant of anticipatory bail, arises out of Mahila Police Station Case No. 44 of 2024, registered on 08.06.2024 for the offences under Sections 341, 323, 504, 506, 313, 498(A)/ 34 of the Indian Penal Code and Section 1⁄2 of the Dowry Prohibition Act.

Learned counsel for the petitioner submits that the case was sent for mediation by this court, vide order, dated 27.03.2025, and in the mediation between the husband and wife, the case has been compromised, and a final mediation report has been prepared and signed by both petitioner and O.P. No. 2 on 11.07.2025.

4. Learned counsel for the O.P. No. 2 supports the

Patna High Court CR. MISC. No.7521 of 2025(3) dt.23-07-2025 2/2 argument of learned counsel for the petitioner.

5. Considering the fact that the matter has been compromised between husband and the wife, and a mediation report has been submitted by the learned Mediator having terms and conditions of the documents, I am inclined to grant the petitioner privilege of anticipatory bail subject to the condition that the petitioner shall follow the terms and conditions of compromise mentioned in the mediation report, dated 11.07.2025.

6. This application is, accordingly, allowed.

7. Let the petitioner, above named, in the event of his arrest or surrender before the Court below within four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhojpur at Ara, in connection with Mahila Police Station Case No. 44 of 2024, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure/Section 482(2) of the BNSS, 2023.
