2. The petitioner apprehends his arrest in Shahpur P.S. Case no. 80 of 2024 instituted for the offence under Sections 319(2), 318(2), 338, 336(3), 340(2), 317(5), 61(B) of the Bhartiya Nyaya Sanhita and Sections 66(B), 66 (C) & 66 (D) of the Information Technology Act.
3. As per prosecution case, on 03.09.2024, the informant received a secret information regarding cyber fraud operation in the garden of Daya Singh in village Rewara. On receipt of said information, the informant with his team went there to conduct raid, however, after seeing the police party, the accused persons started fleeing away, but three of them were apprehended alongwith mobile phones, SIM cards and customers data sheets. 4. Learned counsel for the petitioner submits that petitioner has been made accused in this case only on the basis of confessional statement of co-accused, who were apprehended on spot. No incriminating article has been recovered from the possession of this petitioner. Similarly situated co-accused Shivnandan Kumar has been granted anticipatory bail by a coordinate Bench of this Court, vide order dated 21.02.2025 passed in Cr.Misc. No. 10257 of 2025. Petitioner claims clean antecedent.
5. Learned A.P.P. for the State has opposed the bail petition.
6. Considering the aforesaid facts and circumstances, let the above named petitioner, in the event of arrest/surrender within a period of eight weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. - VI, Nawada in connection with Shahpur P.S. Case No. 80 of 2024, subject to condition as laid down under Section 482 of the Bhartiya Nagrik Suraksha Sanhita, 2023. (Prabhat Kumar Singh, J) anay U T
