The petitioner is in custody since 29.5.2014 in a case under sections 376,313,315,120B of the Indian Penal Code. Learned counsel for the petitioner submits that as per prosecution case the petitioner time and again committed rape on false plea of marriage. He submits that the sexual assault took place in 2010-11 but the case was lodged in 2013. Furthermore, in view of understanding arrived at between the parties, 9 decimals of land has been transferred in favour of the victim, Angustari Khatoon.

In the facts and circumstances of the case, let the petitioner as mentioned above be released on bail on furnishing bail bond of Rs.5,000/- with two sureties of the like amount

Patna High Court Cr.Misc. No.42635 of 2014 (3) dt.04-02-2015 2/2 each to the satisfaction of the Sub Divisional Judicial Magistrate, Purnea in Routa Police station Case No. 18 of 2014 and GR no. 1044 of 2014.
