JUSTICE SHIVAJI PANDEY ORAL ORDER 08-02-2019 Heard learned counsel for the Petitioner, learned counsel for the State and learned counsel for the Informant. In this case, the petitioner is seeking anticipatory bail in connection with Mushahari P.S. Case No.295 of 2018, registered for the offence punishable under Sections 272, 273 of the Indian Penal Code and Sections 30(a), 36, 38 of Bihar Prohibition and Excise Act.

Allegation has been made that about 120 litres of foreign liquor was recovered from a hut. The petitioner fled away taking the benefit of darkness but he was identified. Learned counsel for the petitioner submits that the said hut does not belong to the petitioner and he has no criminal antecedent.

Patna High Court Cr.Misc. No.7431 of 2019(2) dt.08-02-2019 2/2 Looking to the nature of allegation, this Court is not inclined to grant bail to the petitioner.

Accordingly, the prayer for bail is rejected. However, if the petitioner surrenders before the Court below within four weeks from today and prays for regular bail, the Court below will consider the same and pass appropriate order on the same day without being influenced by the order of this Court.
