The name of petitioner has been given in this case on the ground that the petitioner and co-accused, Md. Aslam took the deceased and subsequently, in course of investigation, one witness claimed to have seen the petitioner and Aslam in the company of deceased, prior to his murder. Furthermore, purse of the petitioner is said to have been recovered from the place of occurrence. At paragraph-20 of the case diary, one witness claimed that prior to the alleged occurrence, the deceased along with petitioner and coaccused, Aslam Mian had come to her home and remained there till night but in the morning, he found that the deceased was killed and the petitioner and his associate, Aslam Mian were not present

Considering the aforesaid facts and circumstances of the case as well as submissions of the parties, let the petitioner named above, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Basantpur P.S. Case No. 61 of 2015 to the satisfaction of Chief Judicial Magistrate, Siwan. (Hemant Kumar Srivastava, J) A.K.V./- U T
