JUSTICE VINOD KUMAR SINHA ORAL ORDER 06-02-2020 The petitioner seeks regular bail in connection with Riga P.S. Case No. 298/19, registered for offences punishable under Section 414 of the Indian Penal Code and Section 30(a) of Bihar Prohibition and Excise Act.

Allegation is of recovery of 60 litres of liquor from the possession of one Mahesh Singh, who disclosed the name of petitioner as his associate. Apart from that petitioner is accused in three more cases of similar nature.

It has been submitted on behalf of the petitioner that he has falsely been implicated in this case on the confessional statement of co-accused and except that there is nothing against the petitioner and he has been in custody since 20.12.2019. Heard learned A.P.P. also.

Having heard both sides, in view of the allegation as

Patna High Court CR. MISC. No.6891 of 2020(2) dt.06-02-2020 2/2 well as criminal antecedent of the petitioner, at this stage, I am not inclined to enlarge the petitioner on bail, however, once the charge is framed, petitioner will be at liberty to renew his prayer for bail.

This application is accordingly dismissed.
