The petitioner is languishing in jail since 09.07.2015 in a case instituted under Sections 364(A) of the Indian Penal Code. As per allegation, when the informant's brother, namely, Chandan Kumar Sao had gone to Jhajha station with one Abhijeet Kumar to boarded train and not returned at about 12.08 P.M., informed from mobile of Chandan Kumar Sao that he has been kidnapped and kidnappers have demanded of Rs.5,00000/- for release, otherwise the head of Chandan Kumar Sao would be chopped of. It is further submitted that the miscreants told if the matter told to the police or any one he will face dire consequence. It has been submitted on behalf of the petitioner that

Patna High Court Cr.Misc. No.42540 of 2015 (3) dt.05-11-2015 the petitioner is in custody since 09.07.2015. Chargesheet has been submitted in the case. Petitioner has got no criminal antecedent. There is no allegation of tampering of evidence against the petitioner. Petitioner is not named in the FIR. The victim is said to have returned on his own and in his statement under Section 164 Cr.P.C, the victim has not named this petitioner.

On behalf of the State, it has been submitted that the name of the petitioner has come in course of investigation. Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned SDJM, Jamui in connection with Jhajha P.S.Case No.22 of 2009.
