The petitioner apprehends his arrest in Masharkh P.S. Case No.531 of 2020, registered for the offences punishable under Sections 341, 307, 323, 324, 354(B),379, 447, 504, 506 and 34 of the Indian Penal Code.

Allegation against the petitioner is that he assaulted the father of the informant on his head with sword due to which the father of the informant sustained injury on the head. Learned counsel for the petitioner submits that the petitioner has falsely been implicated in the present case. It is submitted that there is case and counter case between the parties. It is further submitted that both sides received injury. It is also submitted that prior to institution of the present FIR, the

Patna High Court CR. MISC. No.12726 of 2021(2) dt.03-12-2021 2/2 petitioner lodged Masrakh P.S. Case No.525 of 2020 against the informant and her family members. It is lastly submitted that the petitioner has got no criminal antecedent as stated in para 3 of the bail petition.

Learned APP for the State opposed the prayer for anticipatory bail of the petitioner.

Considering the fact that there is case and counter case between the parties, let petitioner, above named, in the event of his arrest or surrender before the learned court below within a period of six weeks from the date of receipt of a copy of this order, be enlarged on bail on furnishing bail bond of Rs.25,000/- (rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Chapra at Saran in connection with Masharkh P.S. Case No.531 of 2020, subject to the conditions laid down under Section 438(2) Cr.P.C.
