The petitioner seeks bail in Ramgarh (Nuaon) P.S. Case No. 94 of 2014, registered for the offences punishable under Section 379 of the Indian Penal Code in which Section 411 of the Indian Penal Code was added later on.

The informant alleged that the petitioner had taken lift on his motorcycle, but while he was urinating the petitioner fled away with the motorcycle of the informant. Learned counsel for the petitioner submits that the FIR was lodged, but the seizure list was prepared on the same day in which the case number was also mentioned. The seizure list itself is doubtful.

Considering the facts aforesaid and the fact that the

No.41667 of 2014 (3) dt.05-02-2015 stolen motorcycle was recovered from the possession of the petitioner, but the petitioner has remained in jail since 18.06.2014 and he has got no criminal antecedent, he is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bhabua in connection with Ramgarh (Nuaon) P.S.
