JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 04-01-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner happens to be father in law of the deceased. Originally, the case was registered under Sections 302, 201/34 of the Indian Penal Code but after investigation, police submitted charge sheet under Sections 304B, 201/34 of the Indian Penal Code.
Neither the informant nor any other witness has stated about the illegal demand as well as torturing. Moreover, general allegation of murder has been levelled against the petitioner and others.
Considering the aforesaid facts and circumstances as
Patna High Court Cr.Misc. No.43958 of 2015 (4) dt.04-01-2016 2/2 well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, East Champaran at Motihari in connection with Sugauli P.S. Case No. 149 of 2015.
