The petitioner is in custody in connection with Dhanarua P.S. Case No. 179 of 2019 for the offences under Sections 399, 402 of the Indian Penal Code and Section 25(1b)a, 26 of the Arms Act. Learned counsel for the petitioner submits that nothing was recovered from the conscious possession of the petitioner and the name of the petitioner surfaced on confessional statement of co-accused Phulendra Kumar who has been granted bail by co-ordinate Bench of this Court. Petitioner is in custody since 08.05.2019.
Considering the fact that the name of the petitioner surfaced on the confessional statement of co-accused Phulendra
Patna High Court CR. MISC. No.7961 of 2020(2) dt.05-02-2020 2/2 Kumar, the Court is inclined to grant bail to the petitioner, let the petitioner, named above, be released on bail on furnishing bail bonds of Rs.50,000/- (Rupees fifty thousand) with two sureties of the like amount each to the satisfaction of Court of learned Judicial Magistrate, 1st Class, Masaurhi in connection with Dhanarua P.S. Case No. 179 of 2019.
