The petitioners are languishing in custody since 28.4.2014 in a case registered for the offences punishable
Patna High Court Cr.Misc. No.41172 of 2014 (3) dt.23-01-2015 2/3 under Sections 25(1-B)a, 26 and 35 of the Arms Act. From the possession of each of the petitioners, one loaded country made pistol and live cartridge were recovered. It is submitted by the learned counsel for the petitioner Chhotu Dom that on 25.4.2014 an application was filed before the learned Additional Sessions Judge X, Patna in S.T. No. 7 of 2013 that the police unauthorizedly took the petitioner but he is not traceable. On the said application, the learned Additional Sessions Judge called for a report vide order dated 25.4.2014 which has been brought on record as Annexure 3 and thereafter the present FIR has been registered on 28.4.2014 which makes the whole case doubtful.
Considering the aforesaid facts, let the above named petitioners be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned ACJM, Danapur in connection with Danapur P.S. Case No. 200 of 2014.
