The petitioner seeks bail in Hajipur Town P.S. Case no. 157/2015, registered for the offences punishable under Section 394 of the Indian Penal Code.

The petitioner is not named in the FIR. Name of the petitioner figured in the case in the confessional statement of Mukesh Kumar who disclosed that the petitioner was also present at the time of commission of the crime. The petitioner is also said to have confessed his guilt but save and except the confession of the co-accused and the petitioner, there is no other tangible material to show the involvement of the petitioner. The petitioner is in jail since 10.03.2015 but he has not been put on Test Identification Parade. The petitioner has already remained in jail

Patna High Court Cr.Misc. No.44819 of 2015 (2) dt.24-09-2015 2/2 for about six and half months.

Considering the facts aforesaid, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri Kabindra Kumar, Judicial Magistrate 1st Class, Hajipur, in connection with Hajipur Town P.S. Case No. 157/2015.
