Petitioner apprehends his arrest in a case registered under Sections 272, 273 of the Indian Penal Code and Sections 30(a), 32(b), 38(a) of the Bihar Prohibition and Excise Act, 2016.

Allegation is recovery of 156 litres of Beer from the Bolero vehicle.

It has been submitted on behalf of the petitioner that he is innocent and has been falsely implicated in this case. Nothing was recovered from his conscious and physical possession. Petitioner being owner of the said vehicle, has been implicated in this case. Petitioner has no concern with illicit liquor kept in his vehicle and same was without his knowledge

Patna High Court CR. MISC. No.7779 of 2020(2) dt.28-02-2020 2/2 or information. Persons apprehended from vehicle had took the vehicle of petitioner on hire. Petitioner has no criminal antecedent.

Considering the facts and circumstances of the case, prayer of anticipatory bail is allowed and petitioner named above in the event of arrest or surrender before the court below within four weeks from today, Petitioner is directed to be released on bail on furnishing bail bond of Rs. 20,000/- (Rupees twenty thousand) with two sureties of the like amount each to the satisfaction of learned court below, in connection with Lakhisarai (Kabaiya) P.S. Case No. 375 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
