Mr. Lalan Kumar, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE SHAILENDRA SINGH ORAL ORDER 09-05-2025 Heard Mr. Amar Kumar Singh, learned counsel for the petitioner and Mr. Lalan Kumar, learned APP for the State.

2. Petitioner seeks regular bail in connection with Mufassil P.S. Case No. 134 of 2024 dated 16.10.2024 registered for the offences punishable under Sections 25(1-B)a, 26 and 35 of the Arms Act.

3. The main submissions advanced by petitioner's counsel are that the instant matter relates to the recovery of a loaded country-made pistol from the possession of this petitioner but in fact, no independent witness was present at the time of recovery and he has been falsely roped in the alleged recovery, the petitioner has fair and clean antecedent and has been languishing in jail since 17.10.2024 and all the alleged offences are triable by the court of First Class Magistrate and most of the material witnesses of the prosecution are police

Patna High Court CR. MISC. No.9289 of 2025(3) dt.09-05-2025 2/2 officials so the release of the petitioner will not affect the prosecution in any manner.

4. Learned APP appearing for the State has opposed the prayer for bail of the petitioner.

5. Considering the aforesaid submissions and mainly the fair and clean antecedent of the petitioner, his custody period and the completion of investigation against him and also the fact that most of the material witnesses who are to be examined in the trial of the petitioner, are official persons, in my opinion, at this stage, it is a fit case for bail to the petitioner. Accordingly, let the petitioner named-above be enlarged on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of the concerned Court in connection with Mufassil P.S. Case No. 134 of 2024.
