The petitioner has prayed for regular bail in a case registered for the offence punishable under section 304B of the Indian Penal Code.

It is a case of dowry death due to non-fulfillment of dowry demand after that this case has been lodged against the petitioner along with co-accused persons.

Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. The petitioner is mother-in-law of the deceased due to which she has falsely been implicated in this case. The petitioner has no concern mess and business of the deceased as well as her

There is no specific allegation of murder leveled against the petitioner and there is no eyewitness of the alleged occurrence. It is further submitted that the husband of the deceased is already in judicial custody. The petitioner has got no criminal antecedent moreover, she is languishing in judicial custody since 24.09.2022.

Learned APP appearing for the state has opposed the prayer of regular bail.

Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as being a lady, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Nalanda P.S. Case No. 208 of 2022 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nalanda.
