The petitioner seeks bail in a case registered for the offences punishable under Sections 399/402 of the Indian Penal Code and under Sections 25 (1-b)a/26/35 of the Arms Act. It is alleged that the petitioner was traveling in a vehicle and the police arrested the petitioner and many others. From the possession of the petitioner only one mobile was recovered. Arms and ammunition was recovered from under the bonnet of the vehicle and not from the conscious possession of the petitioner. The petitioner has, of course, got criminal antecedent and he is accused in as many as four criminal cases. The petitioner is in jail since 03.04.2015. Similarly situated co-accused Sharwan Kumar Singh @ Rahul Kumar Singh has already been enlarged on bail

Patna High Court Cr.Misc. No.45380 of 2015 (2) dt.01-10-2015 2/2 vide orders passed in Cr. Misc. No. 43668 of 2015 on 21.09.2015. Considering the facts aforesaid, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Banka in Banka P.S. Case No. 195 of 2015.
