The petitioner seeks bail in a case registered for the offence under Sections 399, 402, 353, 332, 307 of the Indian Penal Code and Sections 25(1-b)a, 26, 27, 35 of the Arms Act. As per the prosecution case, on 25.05.2021, on a secret information that one notorious criminal Vicky Mahto alongwith his associates are planning to commit dacoity, a raid was conducted and one co-accused Md. Raza was apprehended with one country-made pistol alongwith two bullets, whereas other accused persons fled away.

It is submitted on behalf of petitioner that petitioner was neither arrested on the spot nor any incriminating article was recovered from his possession. Petitioner has been

Patna High Court CR. MISC. No.8986 of 2022(2) dt.12-04-2022 2/2 implicated in this case on the basis of confessional statement of co-accused Santosh Kumar Chhuhwa. Petitioner is in custody since 07.10.2021.

Learned A.P.P. for the State has opposed the bail petition.

Considering the aforesaid facts and circumstances, the bail petition of petitioner is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Barh, Patna / concerned court in connection with Maranchi (Panchmahla O.P.) P.S. Case No. 53 of 2021.
